Rit Filed in Supreme Court Against Chief Justice Recommendation, Alleging Seniority Breach

A writ petition has been registered at the Supreme Court of Nepal against the Constitutional Council’s decision to recommend a new Chief Justice, claiming that the principle of seniority was not followed.

Senior advocates Dinesh Tripathi, along with advocates Bipin Dhakal and Dr. Prem Silwal, have filed separate petitions. They argue that the Council’s decision made on Baisakh 24 was unconstitutional, arbitrary, and taken with bad intent.

The petitioners have demanded that the recommendation be annulled and a directive order (mandamus) be issued to appoint the most senior eligible candidate as Chief Justice. On Baisakh 24, the Constitutional Council had recommended Dr. Manoj Kumar Sharma for the post of Chief Justice.
