Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Nepalytix website, platform, services, content, and products (collectively, the "Service"). By accessing or using Nepalytix, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. About Nepalytix

Nepalytix is a financial data and analytics platform built specifically for the Nepal Stock Exchange (NEPSE). It is operated by Cognify System Pvt. Ltd, a company registered in Nepal. The platform provides stock market data, AI-driven insights, portfolio tracking, and NEPSE-focused investment tools.

2. Eligibility

You must be at least 18 years old to use Nepalytix. By using the platform, you confirm that:

  • You are legally capable of entering into a binding contract.
  • You are not prohibited from using our services under any applicable law.

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and complete information when registering.
  • We reserve the right to suspend or terminate accounts that violate these terms.
  • You may not share your account with another person or use another person's account.

    • 4. Subscription Plans and Payments

  • All payments are processed via Fonepay or direct bank transfer. Payments must be confirmed by sending a transaction screenshot to our WhatsApp number. Access is activated within 30 mins of payment confirmation.
  • Annual plans are billed once per year. Your plan will not auto-renew unless you explicitly choose to renew.
  • All payments are final. We do not offer refunds once access has been granted. If you experience a technical issue preventing access, contact us at [email protected] within 48 hours of payment.

    • 5. Acceptable Use

    You agree not to:

  • Use the platform for any unlawful purpose or in violation of any applicable laws in Nepal.
  • Attempt to gain unauthorized access to any part of the platform or its infrastructure.
  • Scrape, copy, redistribute, or resell any data or content from Nepalytix without written permission.
  • Use the platform to spread misinformation or manipulate market sentiment.
  • Reverse engineer, decompile, or disassemble any part of the platform.
  • Use automated bots or scripts to access the platform without prior written consent.
  • Upload or transmit any malicious code, viruses, or harmful content.

    • 6. Intellectual Property

    All content on Nepalytix including but not limited to the platform design, code, data visualizations, AI models, reports, and branding is the property of Cognify System Pvt. Ltd. You may not reproduce, distribute, or create derivative works from any content on the platform without express written permission.

    The Nepalytix name, logo, and brand identity are trademarks of Cognify System Pvt. Ltd.

    7. AI & Data Disclaimer

    Nepalytix uses data analytics and AI models to provide insights. These are:

  • For informational and educational purposes only.
  • Not a substitute for professional financial, legal, or investment advice.

    • We do not guarantee the accuracy, reliability, or profitability of any content, data, or insights offered through our platform.

    You use the platform at your own risk.

    8. Third-Party Data and Services

    Nepalytix sources market data from publicly available NEPSE records and third-party data providers. We use TradingView for charting functionality. While we make every effort to ensure data accuracy, we cannot guarantee that all data is complete, accurate, or up to date at all times.

    We are not responsible for the content or practices of any third-party services linked to or integrated within the platform.

    9. API Access

    The Nepalytix REST API is provided for personal and research use. Commercial use of the API requires a separate written agreement with Cognify System Pvt. Ltd. We reserve the right to rate-limit or revoke API access if usage is deemed excessive or harmful to platform performance.

    10. Disclaimer of Warranties

    Nepalytix is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the platform's reliability, accuracy, or fitness for a particular purpose. We do not guarantee uninterrupted or error-free service.

    11. Limitation of Liability

    To the maximum extent permitted by applicable law, Cognify System Pvt. Ltd shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the platform, including but not limited to financial losses resulting from investment decisions made using Nepalytix data or tools.

    12. Indemnification

    You agree to indemnify and hold harmless Cognify System Pvt. Ltd, its directors, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the platform or your violation of these terms.

    13. Modifications to the Platform and Terms

    We reserve the right to modify, suspend, or discontinue any part of the platform at any time. We also reserve the right to update these Terms and Conditions. We will notify users of material changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the updated terms.

    14. Governing Law

    These Terms and Conditions are governed by and construed in accordance with the laws of Nepal. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
